Terms of service

These terms are between you and Kestrel Legal Support Operations LLC. Effective Oct 30, 2026. Version 2026-10-30.

We cannot give legal advice

We are not attorneys and cannot give legal advice. We cannot tell you which court to file in, what your deadline is, whether service was sufficient, or what a document means. Those are questions for an attorney or for the court's self-help center.

Effective October 30, 2026. These terms apply to orders placed on or after that date.

These terms govern services provided by Kestrel Legal Support Operations LLC, a Colorado limited liability company (“we”, “us”), to the person or organization ordering them (“you”).

You accept these terms by checking the box on the review step of the order form, which links to them, and then placing your order. We record which version you accepted and when.

1. What we do

We provide process service, court runs and document delivery, and mobile notary services in person, in the Colorado counties listed on our service areas page.

We do not serve eviction papers of any kind: demands for possession or compliance, eviction summonses and complaints, or writs of restitution.

We are not a law firm and we are not attorneys. We cannot and do not give legal advice. Nothing on this site and nothing said by us in the course of an order is legal advice. We do not advise on which court a matter belongs in, what any deadline is, whether service was legally sufficient, whether a filing is complete or timely, or what any document means. Those questions are for an attorney, or for the court.

2. Who may order what

Process service, court runs and notary services are available to law firms, agencies, businesses and individuals.

3. Your responsibilities

You are responsible for:

  • the accuracy of the names, addresses, county, court and case information you give us, and for confirming the county when a ZIP code crosses a county line;
  • the documents you send us and the lawfulness of what you are asking us to do;
  • confirming, as the order form requires, that we are not being asked to serve papers in a matter we are a party to;
  • telling us any deadline you are working to, before you place the order, so we can tell you whether the tier you chose can reach it;
  • for a subpoena that commands someone to appear, sending with the order the witness fees and mileage that must be tendered with it, so we can tender them when we serve;
  • keeping your portal access and tracking links secure.

We act on the information you give us. We do not verify that an address is current, that a party is the right party, or that a document is the right document.

4. Quotes, prices and pass-throughs

Every quote is itemized and separates service fees, which are ours, from pass-throughs, which are third-party money charged at cost: court fees, clerk fees and state fees.

The quote you accept is the price. Parking, set out below, is billed in addition, after the job. Rates published on the site are the rates we charge, but where a published rate and an accepted quote differ, the accepted quote governs for that order.

Where we advance a pass-through on your behalf, you pay exactly what the court, clerk or agency charged, with the receipt, and nothing is added. We will not pay a third-party fee greater than the amount you authorized without asking you first. That does not apply to parking, which is set out below.

Parking. If we have to pay for parking to do the work, which is common in downtown Denver, you pay exactly what we paid, with the receipt in your client portal. Parking cannot be included in the quote, because no one can know in advance whether a free space will be available or how long a wait will take, so it is billed after the job. Nothing is added: no markup and no advance fee. We will not charge more than $30.00 in parking on one order without asking you first. If we bill parking in error, we refund it. Otherwise parking is never discounted, and it is never refunded once we have paid it. If an order is cancelled, parking we paid before the cancellation is still billed. This applies to process service, court runs and document delivery. It never applies to a notary appointment.

How you pay for parking follows how you paid for the order:

  • If you pay for the order at checkout, you check a box at payment authorizing us to have our payment processor keep the card on file and charge it once, after the order is finished, for the parking we paid on that order, up to $30.00, with the receipt. The processor stores the card; we never see or store the card number. We use the saved card only for parking on the order it paid for. If the charge does not go through, if there is no card on file for the order, or if you approved parking above $30.00, the processor emails you a link to pay by card, due within 14 days.
  • If your account is invoiced monthly, each order’s parking is one line on your next monthly invoice, even if the order was placed in an earlier month. You pay it with the rest of the invoice, by ACH bank transfer or check.

We email you when parking is charged to your card or when a link to pay it is sent. We do not send text messages about it.

5. Payment terms

Individuals prepay. Agencies prepay until they place fifteen or more process service orders in a calendar month; from the following month they are invoiced monthly on the same terms as law firms. Law firms prepay their first two orders and then move to a net-30 monthly invoice, unless we have agreed different terms in writing on the account.

Invoices are issued monthly and are due 30 days after issue. Invoices are paid by ACH bank transfer, or by check made payable to Kestrel Legal Support Operations LLC and mailed to the address on the invoice. We do not accept card payment on invoices.

If an invoice is more than 30 days past its due date, new orders are prepaid until it is paid. Any amount not paid by its due date bears interest at 8% per year, compounded annually, from the due date until it is paid. There is no late fee.

Fifteen or more process service orders in a calendar month earn a 10% discount on that month’s service fees, credited on that month’s invoice. The discount applies to invoiced months only. Pass-throughs and parking are never discounted.

6. Cancellation and refunds

You may cancel an order at any point before it is complete. A process service order may be cancelled at any point until the person is served. A cancellation takes effect when we receive it by email or phone, and we judge how far the order had progressed at that moment. What we refund depends on how far the order had progressed when it was cancelled.

Before anyone sets out, meaning before the server or courier heads out for the order, or before the notary leaves for the appointment, we refund everything you paid, pass-throughs included, less a $5.00 cancellation fee. The fee is the same however you paid.

On the way, before any work is done, we keep the cost of the trip and refund the rest, pass-throughs included:

  • on a process service order or a court run, a trip fee of $35.00;
  • on a notary appointment, the travel or facility-visit fee and any after-hours fee. We refund the notary fee, because no notarization took place.

After work is done, meaning an attempt at service has been made, the documents have reached the clerk’s counter, or the notarization is complete, nothing is refunded, except pass-throughs we had not yet paid out, which we always refund. The fee for an attempt is earned whether or not the attempt reaches the person.

On an invoiced order, the same amounts apply: we credit the rest on the invoice and bill only what we keep.

Parking we have paid is never refunded, except parking billed in error, as section 4 sets out.

Changing instead of cancelling. Before we set out, you can change an order rather than cancel it: correct a name or address, add or remove a party, or change the speed. Changes are free. If the price goes up, you pay the difference; if it goes down, we refund the difference.

Notary appointments may be rescheduled free of charge until we set out for the appointment. If we arrive and cannot notarize, because a signer is missing, has no acceptable identification, or does not appear to understand what they are signing, that is not a cancellation: we charge no notary fee for a document we did not notarize, and the travel or facility-visit fee stands.

An order that is still waiting for payment, or for you to accept its quote, 60 days after it was last updated is cancelled automatically. Nothing has been charged on it, so nothing is owed.

7. The rush guarantee

On a rush or same-day process service order, if we do not make the first attempt by the deadline for that tier, we automatically refund the difference between that tier and the standard rate, or on an invoiced order credit it on that invoice: $60.00 for each party charged at the rush rate and $130.00 for each party charged at the same-day rate. You keep the service and the remaining attempts.

The refund or credit is owed once the deadline passes, whether or not an attempt has been made, and is given without you asking for it.

This is a refund or credit of a speed premium. It is not a guarantee that service will succeed.

8. Service may not succeed

We provide attempts and documents. We do not provide outcomes.

If we cannot serve a party, you receive a signed declaration recording each attempt with its date, time, address and outcome. That declaration is the deliverable in a non-service, and the service fee is earned by the attempts made.

We do not warrant that any person will be located or served, that any document will be accepted by any court, or that any service or filing will be found legally sufficient by any court.

9. Documents, records and your data

Documents you upload are stored encrypted and are available to you in the client portal. Proofs of service are available for download there. Attempt records include the date, time, address and location of the attempt and may include photographs.

We keep records for the periods our privacy policy sets out, and longer only when a record has become evidence in a dispute or the law requires it. See the privacy policy.

Each notary records their acts in their own paper journal, which is the official record of the act. We do not store identification numbers.

10. Communications

We send order notifications by email. We send text messages only to a number that has opted in. Order notifications by text contain only our name, the order reference, a short status phrase and a tracking link. See the SMS terms.

A tracking link opens without a sign-in. It contains no addresses, party names or case numbers, but anyone who has the link can see the order’s status and attempt timeline. Please keep the link secure, as section 3 asks.

11. Limitation of liability

To the fullest extent the law allows, our total liability for all claims arising out of or relating to an order is limited to the service fees charged for that order. This limit does not apply to fraud, to willful and wanton conduct, or where the law does not allow liability to be limited, including remedies under the Colorado Consumer Protection Act. We are not liable for indirect, incidental, special or consequential damages, or for lost profits, lost cases, missed deadlines or adverse outcomes.

12. Indemnity

If you order for a business, you will indemnify us against claims by others, and the losses and costs they cause, including reasonable attorney fees, arising from the information you gave us, the documents you asked us to serve, deliver or file, and the purpose for which you used our services, except to the extent caused by our own negligence or our failure to perform the service as agreed.

If you order as an individual, you are responsible to us only for losses caused by information you gave us knowing it was false.

13. Changes

We may change these terms. The version in force for an order is the version published when the order was placed. Material changes will be dated at the top of this page.

14. Governing law

These terms are governed by the law of the State of Colorado. A lawsuit about these terms or an order must be brought in the state courts for the City and County of Denver, except a claim in small claims court. Either of us may bring a claim within its limits in small claims court in any county where venue is proper.

16. General

If any part of these terms is unenforceable, the rest still applies. For an account that has signed our client agreement, that agreement governs where it differs from these terms. We may assign an order to any process server or notary who works with us. The person who makes the attempts signs the proof, and the notary who performs a notarization signs the certificate. We remain responsible to you for the work. Anyone who works an order for us is bound to keep it confidential. If you want an order worked only by our own member, say so when you order; it may take longer. You may not transfer these terms or an order to anyone else without our written consent. We may transfer them to a business that takes over our services, and will tell you if we do. A delay caused by weather, a court closure or a system outage outside our control is not a breach, but it does not cancel any refund or credit these terms promise, including the rush guarantee. Notices to us go to the email or mail address above; notices to you go to the email on your account. Not enforcing a term is not a waiver of it.

We are not attorneys and cannot give legal advice.
