Status updates reach your inbox as they happen, every attempt is recorded with its time and location, and every signed proof is kept in your client portal. You should never need to call to find out where an order stands.
What our proof looks like
A proof of service from Kestrel Legal Support Operations LLC is an unsworn
declaration signed under penalty of perjury under the law of Colorado, in the
form used under C.R.S. 13-27-106. Colorado’s civil rules accept a declaration in
this form as proof of service. It is not a notarized affidavit, and we do not
notarize it ourselves, because a notary cannot notarize their own signature.
Each proof names the documents served, the party, and every attempt with its
date, time, address and outcome. When service succeeds, it records how service
was made and to whom the papers were delivered. When it does not, it records
each attempt in the same detail, so you have a declaration of what was attempted
either way.
The signed PDF is delivered to your portal.
For a court outside Colorado, attach that court’s own proof form and we will
complete it, or order a notarized affidavit. It is $20 per party served, plus a
$15 notary fee, the legal maximum, charged by the notary who notarizes it: the
server signs an affidavit, and a separate notary notarizes it. If your matter
needs a different form of proof, let us know before we serve and we will tell
you whether we can provide it. Whether a particular proof satisfies a particular
court is a decision for you or your client.
Billing details
Your first two process service, court run and notary orders are prepaid. After
that, your account moves to a net-30 monthly invoice, issued on the first of
the month, covering every order closed in the previous month and itemized with
your matter reference on each line.
Invoices can be paid by ACH bank transfer, or by check payable to Kestrel Legal
Support Operations LLC and mailed to the address on the invoice. We do not
accept cards for invoices.
Fifteen or more serves in a calendar month earn 10% off that month’s service
fees, credited on the next invoice. Pass-throughs are not discounted.
Court and clerk fees are shown as a separate total, at cost, so your cost
recovery matches what we paid. When we advance a court fee for you, you pay
exactly what the court charged, with the receipt attached and no advance fee.
Parking is the one cost we cannot quote in advance. When we have to pay to
park on a serve, court run or document delivery, which is common in downtown
Denver, it appears on your next monthly invoice as one line per order, at
exactly what we paid, with the receipt in your portal, even if the order was
placed in an earlier month. We will not charge more than $30.00 in parking on
one order without asking you first. On a prepaid order, it is charged once to the card used to pay for the
order after the job is finished, as you authorize with a checkbox at payment.
If an invoice is more than 30 days past its due date, new orders are prepaid
until it is paid. Past-due amounts accrue interest at 8% a year. There is no
late fee.
What we do not do
We do not give legal advice, including on questions that may seem routine, such
as which court to file in, when a deadline falls, or whether service was
sufficient. If a question like that comes up, we will refer it to the
responsible attorney or the court clerk.
We are not attorneys and cannot give legal advice.
We do not currently offer e-filing or litigation support. A court run covers the
counter: we take papers your firm has prepared and signed to the clerk, file
them or pick them up, and bring back the receipts or certified copies. Your firm
remains the filer.
We also cannot serve papers in any matter to which we are a party, and we ask
every client to confirm this when ordering.
Coverage and addresses outside it
Adams, Arapahoe, Boulder, Broomfield, Denver, Douglas and Jefferson counties are
served at the rates above. Outside those counties, we add $1.00 a mile round
trip to the tier price and send you a quote before anything is charged.
Service is not always successful. Addresses go out of date, the wrong person
answers, or no one is home on any of the four attempts. When service is not
completed, you receive a declaration of the attempts made.
If early attempts show the address is bad, because the party has moved, the
property is vacant or the unit number is wrong, we contact you before making the
remaining attempts. You can choose to stop, have us search for a new address
with a skip trace at $75 ($40 if no new address is found), or continue. The
service fee is flat and is not refunded.
